1. Licenses to all content and programming of the CD–ROM and Web Site resources of Canada, Confederation to Present are owned by Chinook Multimedia Inc. (hereinafter called Chinook) and are protected by Canadian and international copyright laws. Any unauthorized use or reproduction is strictly prohibited by law. The CD–ROM and Web Site resources of Canada, Confederation to Present are for personal, non–commercial use.
2. Chinook hereby grants, and the Licensee accepts, a single non–transferable and non–exclusive License to use the CD–ROM and Web Site resources of Canada, Confederation to Present for internal purposes subject to all terms and conditions of this agreement. This License is personal to the Licensee and the License rights may not be transferred to third parties.
3. The Licensee may not assign, sublicense, or transfer this agreement.
4. Licensee may only install, run, access, or use the CD–ROM on a single computer at one time. If the software is installed on a second computer it must be removed from the first. Licensee is allowed to make a single backup copy of the CD–ROM which can only be used for archival purposes.
5. Licensee shall not adopt any part of the CD–ROM and Web Site resources of Canada, Confederation to Present as its own. Copyright and proprietary notices shall not be removed from the CD–ROM and Web Site resources of Canada, Confederation to Present.
6. The Licensee shall not use the CD–ROM and Web Site resources of Canada, Confederation to Present for any other purposes than those purposes defined by this agreement. Any use beyond this agreement requires explicit written permission of Chinook or a separate agreement.
7. While the software in the CD–ROM and Web Site resources of Canada, Confederation to Present has been tested for accuracy and proper functionality, Chinook disclaims any responsibility for the software functioning or for the Licensee's use or application of the software. Chinook makes no representation or warranty, either expressed or implied, of the merchantability or fitness for a particular purpose. Chinook does not warrant or guarantee results from the use of software. As the software is provided on an “as is” basis, the Licensee agrees that neither Chinook nor any of its officers, directors, employees, or agents will be liable in any event for any consequential, special, incidental, or indirect damages arising out of or in connection with this agreement or the performance of the software or WWW site.
8. The content in the CD–ROM and Web Site resources of Canada, Confederation to Present has been carefully reviewed for accuracy; however, Chinook cannot guarantee correctness and accuracy of the content.
9. Chinook is not aware of any third party rights to the software and is not liable for the software being bound by any third party rights.
10. Chinook is not aware of any copyright infringement of any third party data and has made every reasonable effort to determine copyright of third party data; please notify Chinook in the event of any inadvertent copyright infringement and Chinook will make every effort to remedy the situation in subsequent editions of the CD–ROM or Web Site.

12. Chinook will provide no maintenance or installation services of any kind hereunder.
13. This License is effective as of date of acceptance by the Licensee.
14. This License is automatically terminated if the Licensee is in a breach of this Agreement.
15. All rights of the Licensee terminate at the expiration of this License.
16. This agreement is governed by laws of the Province of Alberta, Canada.
17. Should any provisions of this agreement be held to be unenforceable, the remaining provisions will remain in full force and effect.
